Evidence has been mounting for 4 weeks now though

I think they know something regarding fraud or some contact with civil lawyers early on - something relating to one of her inner circle and Money.

No matter what, Kimberley Gilfoil moved to another level last night - and it was Kimberly Gilfoil that said on Hannity - How did she pick out the 3 wealthiest players on the team?

she went from talking about the family talking to civil lawyers to that statement - how did she pick the 3 wealthiest. A statement I had not heard anyone else on the major networks bring up.

Everything is out in the News Corpse before it is published or broadcasted: remember the DNA link to the third player that Fox was reporting days before the DNA testing came back.

check out this letter in a blog to the North Carolina News and Observer:

The News & Observer focused on the Duke Player's behavior to an inordinant extent in the first month of reporting.
Ted Vaden even wrote that N&O Editor, Melanie Sill takes the stance that that are two scandals at Duke. The Team's drinking (off-campus) drinking and the Gang-rape accusation.

So, while the N&O was acting with righteous indignation at the team's minor indiscetions that happen at every college in the country - the stripper making gang-rape accusations for the second time was also a student attending another local University - NCCU. The accuser - known as Mary Poppins to N&O readers - has the following in her background: the woman was charged with felonious assault with a deadly weapon [the stolen taxi] on a government officer, felonious larceny and felonious possession of a stolen vehicle, felonious speeding to elude arrest, driving while impaired, driving with a revoked license, driving while left of center, ignoring an officer's blue lights and siren, reckless driving, driving the wrong way on a dual-lane highway, having an open alcoholic beverage container in the car, two counts of damaging personal property and resisting a public officer.

Let's see - Drinking at off-campus Frat parties - or Felony Car-Jacking and trying to run over an officer of the law after taking the police on dangerous high speed chase across two counties while driving on a revoked license - and this really sticks in my craw - "an open alcholic beverage in the car."

We have to believe the N&O didn't know about the open container in the vehicle or I'm confident they would've trashed the accuser like they trashed the lacrosse players.

I don't think Mangum consented to a tox or a BAC.. At the point that she converted herself into a crime victim, she was in the driver's seat as far as any tests go. When she was going to the drunk tank and then onto the drug/nut ward, she was in custody and probably could not refuse a test. Once she was at Duke Medical as a crime victim, she was released from custody into the hospital staff. She doesn't have to consent to those tests.

I will be surprised if she consented to a tox screen.

and her detailed descriptions of the party and players in the photo line up doesn't jive with being drugged. if there was a tox test pointing in that direction, then there would be some splaining to do about the photo lineup and details provided.

I think he did believe her, but I don't think he does anymore and hasn't since the first DNA results came back. Since then, he's been trying to make a silk purse out of a sow's ear. What he has going for him is control of records and the court process, but that's just a stalling game. It's not an end game.

That Newsweek snoot, Susanne Meadows, has been on the prosecution's side all along. You can tell she's a graduate from some east coast limousine liberal school. I cannot stand her looks (looks like a wallflower - drab, sad-sack horse face) or the way she talks. She's got the typical lefty cold, controlled, emotionless "I'm always right and I am superior" tone of voice, speech pattern and phrasing, and general attitude. I can only hope that someday she is accused of some heinous crime she did not commit.

I did, and Tucker handles her better than anybody else does. He needs to stop booking her, though, because she is not rational, and it diminishes him to even talk to somebody as unhinged and rabid as she is.

I agree with your assessment. I think Nifong was shocked when the first DNA results came back because he did not know about the romp with the boyfriend. Nifong thought he had a silver bullet with semen inside the complainant, an allegation of a recent sexual assault, and no other recent consensual sexual relations. This explains his earlier statement about DNA being conclusive.

Once those first results were back, Nifong should have backed away from this case or allowed the DPD to further investigate. However, by that point, he was too far out on a limb given his earlier trial by media conduct.

I think you can always refuse a BAC test. Fifth ammendment right to not provide self incriminating evidence.

Normally, refusal means automatic revocation of DL for a period of time.

Many lawyers would tell you if it is your first offence, and you have never been in trouble before to go ahead and take it. In most states you will most likely get a diversion. You should also request to be taken to the hospital for an independent test (another 20-30 mins could mean a little lower level, especially if you are borderline.)

On subsequent incidents you should probably refuse, and try to fight it out in court.
