Nifong Wants Addresses, Key-Card Data In Duke Lacrosse Case

District Attorney Mike Nifong is accused of going on a "fishing expedition" in the Duke lacrosse rape investigation.

Nifong issued two subpoenas asking Duke University to hand over the home addresses for all of the lacrosse players as well as two other people.

Nifong also wants the information from the students' key cards that track their movements on campus.

I don't know, but Tom Manning is one of the most respected attorneys in Raleigh.

On what legal basis can he force Duke to give over any information on the unindicted students? I think he's looking to get a smackdown from a judge.

He's realized the indicted aren't guilty and he's hoping against hope he'll turn up something to pressure the other players.

The WRAL story shows another attorney, but the story I read this morning says Tom Manning is the attorney who filed the motion to quash. Maybe both?

Nifong is a rogue attorney - he should be impeached - if possible.

If this case turns out the way it appears to be, he should be investigated by the State of North Carolina for abuse of office.

The judge should say "I can't imagine why that would be relevant to this case" which is approximately what Nifong said when the defense asked him to turn over Crystal's phone. Anybody heard whether he has done so?

"The accuser told the nurse "that she was not choked; that no condoms, fingers or foreign objects were used during the sexual assault," the lawyers wrote in a sworn statement. The nurse noted that the accuser's arms, legs, head, neck, nose, throat, mouth, chest, breasts and abdomen were all normal, the court filing said. The lawyers filed the accuser's medical records under seal with the court."

"She heard that (the accuser) was sexually assaulted, which she stated is a 'crock' and she stated that she was with her the whole time until she left," according to Himan's notes. "The only time she was alone was when she would not leave and that time period was less than five minutes."

Right there you can see what a liar Nifong is- didn't he say she was choked and even demonstrate how it happened? He must have known what the SANE report said early oo, so he told a complete lie to the media.

Nifong was hoping that the phone battery would go dead before he turned it over. The funny thing is that all records are on file at the cell phone company, regardless of whether the number had been disconnected, the phone battery died, or whatever. So my question is: "What is in or on the phone that would not be in the phone company records?" The answer is "The phone number listings."
