SEVIERVILLE — A former Seymour High School teacher caught performing oral sex on a student pleaded guilty this morning to statutory rape.
District Attorney General Al Schmutzer, Jr. recommended an 18-month sentence for Kristi Dance Oakes.
Sevier County Circuit Court Judge Dick Vance set a sentencing hearing date for July 24.
Oakes’ plea stems from a June 23, 2004, incident. A police officer at 11:30 p.m. found her topless and performing oral sex on the then 16-year-old student.
She resigned from her position as a biological sciences teacher at Seymour High School soon after the charges.
Oakes’ lawyer Barry Valentine sought pretrial diversion for Oakes, a move that would have kept the conviction from ever being entered against her if she behaved well during a probationary period.
Schmutzer denied the petition for the judicial break. A state appellate court in January ordered him to reconsider his decision.
In April, Vance again denied Oakes' bid for pretrial diversion and set a June 21 trial date.
Oakes, a married mother, is currently free on bond.

Not identifying the sex of the student narrows this down to a subset of the statutory rape crime.
