I think they should let them both go. Ultimately, yeah. The guy driving passed his Breathalyzer and his completely inebriated passenger (0.237 percent is freakin' hammered!) didn't really have any control of the vehicle.
And the cops have no proof.

Yeah, I agree. I'm not sure any crime was committed and stupidity isn't illegal.
