Foley has had previous run-ins with law enforcement. Last week, the San Diego County District Attorney's office said it would not pursue charges against Foley for an incident in April. He was accused of resisting arrest, battery on a police officer and being drunk in public after an altercation on a University City street about 1:30 a.m. April 21.

He got away with it the first time. He thought he could get away with it again.

If I were the prosecutor, he'd be facing felony charges arising out of both incidents as soon as he was up and on his feet again. His companion driving the car would be facing attempted murder charges. It's sometmes easy to sow reasonable doubt if one incident is charged. But if two similar incidents are charged involving different police officers on different dates, reasonable doubt starts to dry up and blow away.

Oh I agree,the team should cut it loses with him too,this is not his first few brushes with LEO.

The DA is going to want this one to go away. Notice that the cop shot before the woman tried to escape in the car.

This is a contract hit that went sour, not just a bad stop on a DUI charge. Besides, the officer seems not to have called in for assistance on this one, but we shall see.

Foley's gonna' get rich off the public Fur Shur.
