He got away with it the first time. He thought he could get away with it again.
If I were the prosecutor, he'd be facing felony charges arising out of both incidents as soon as he was up and on his feet again. His companion driving the car would be facing attempted murder charges. It's sometmes easy to sow reasonable doubt if one incident is charged. But if two similar incidents are charged involving different police officers on different dates, reasonable doubt starts to dry up and blow away.
