How deep are Nifong’s pockets? Logic alone requires remedy commensurate with the damage done.

“But, not all prosecutorial conduct enjoys absolute immunity. To the contrary, in Buckley v. Fitzsimmons, the Supreme Court held that a prosecutor was not absolutely immune from civil liability for false statements made in a press conference and for other pre-trial investigative conduct; in that case, only "qualified immunity" applies.

The Court explained that this is because "[t]he conduct of a press conference does not involve the initiation of prosecution, the presentation of the state's case in court, or actions preparatory for these functions." In other words, press conferences aren't an integral part of the prosecutor's job; they are an extra function that he chooses to perform. Prosecutors could opt not to do any press conferences, if they so chose, and still perform all the core duties of prosecution. “

Interesting article concerning political endorsements for DA in Durham.

The endorsements are rolling in for next month's general election.

The political action committee of the Durham People's Alliance is urging a straight Democrat vote, but urging its 400 or so member to skip a couple of races.

District Attorney Mike Nifong, a Democrat running in what is probably the most publicized race this year, was among those who got the Alliance's nod.

The more conservative Friends of Durham did re-interview candidates, but isn't collectively endorsing anyone for district attorney. Chairman David Smith said earlier this week the committee was just as conflicted as the public over the race and wasn't able to reach agreement after interviewing all three candidates, even City Councilman Lewis Cheek, who has pledged not to serve if elected.

The third heavyweight local political action committee, the Durham Committee on the Affairs of Black People, plans to interview candidates next week. It's said that the endorsement of two out of the three groups is needed to win election in Durham.

Any idea on who the Durham Committee on the Affairs of Black People will endorse? And does it really matter at this late date?
