If continuing a prosecution that the da knows is false isn't a violation of due process, than what is? First you have to prove that he "knows" the charges are false and if you can prove that, it's sure an ethics violation under the state code of conduct, and a major one at that, but I don't know if it violates Federal due process requirements, unless they are convicted of a crime.

The State Attorney General and Governor refuse to do anything, therefore the Department of Justice and the Federal Prosecutor can step in. You should have seen the form letter that the NC Attorney General sent out. He washed his hands and said that the prosecutor in Durham need only answer to the voters, since it is an elected office. I suppose with logic like that, the DA could have been murdering witnesses and the AG would still wash his hands of it?

Taking over the case is not the issue. The AG certainly has the authority to investigate Liefong, but would have to have received a request from Liefong to take over the case itself.
