Because Britney Spears has a number one hit album, she should have more time to show up for court-ordered random drug tests, her attorney told a court commissioner Thursday.
Los Angeles Superior Court Commissioner Scott M. Gordon had given the pop singer one hour to respond when a lab calls her for a drug test.
During an unscheduled hearing Thursday morning, Spears' lawyer, Anne Kiley, called that arbitrary and unconstitutional.
She said Spears should have six hours to make preparations to be tested.
Primary custody of Spears' children -- Sean, 2, and Jayden James, 1 -- is with their father, Spears' ex-husband Kevin Federline. She has visitation privileges that include one overnight stay by the children with her per week.
Federline's lawyers asked for Thursday's hearing to complain that Spears is not complying with the drug testing order and is not responding to calls from the testing facility within the time frame ordered by Gordon.
Gordon said he does not believe Spears should be treated different from other people who get calls from labs in the morning.
"I have to get here at 7:30 a.m. to read (court) papers," Gordon said in reference to documents filed in connection with today's hearing.
Kiley said Gordon's situation is different.
"But you're not a pop star with a number one album," Kiley said.
Kiley also defended Spears for changing her telephone number so often, saying it is necessary because she is famous and people are always getting access to her personal information.
But Federline's lawyer, Mark V. Kaplan, said Gordon's order is a simple one and that Spears has no justification in changing her contact information so often.
"We are all bending over backwards to bring Miss Spears' conduct with that of ordinary people and it is Miss Spears who is the fly in the ointment," Kaplan said.
Gordon ruled there needs to be one number that the testing facility calls for Spears' response. If she changes that number, everyone involved must be notified.
It really isn't about the kids. It is about the child support payments that will go to the custodial parent. Britney rakes in about $750,000 a month income. Those checks to Kevin are going to be pretty fat if he gets to keep those kids.
