...2 neighbors showed up yelling at the commission. Not so sure I want to live there now.....That might be their strategy to remain unbothered by more neighbors; act unpleasant enough and no one will want to be near them.
If your name is not Kennedy, you might wat to consider a name change!
As an afterthought, what was the substance of the yelling?

That they hadn’t had a chance to see the plans even though they were “noticed” and the plans were on file with the town 4 weeks. They said the house design was “gorgeous” and “beautiful” but did not want the cottage replaced. To say they were rude to the commission is an unstatement.

Let the neighbors play the role of heathen in front of the commission. As for you, be polite and courteous to the commission. As long as you are within the law, Lord willing, you'll get your way.
This has been my experience with the local gov. Good luck.

You’d better check any covenants in the area that have restrictions on the heighth of your proposed structure, fottprint and total SF.
A number of people in the state of Washington have assumed that once a building is built that does not comply, they may at most face some sort of fine. They have been wrong. In every instance, the courts have ordered them to tear it down or modify the structure in order to comply with the restrictions.

We are below the height restriction and are below the SF alotted us in a rebuild.
DOes anyone know if my land is land courted if someone can get a perscriptive easement of right of way over my property?

Put ‘em on notice (that things could be worse (for them)). You could bargain it away to curry favor.

You’re talking Massachusetts here.I hope it doesn’t surprise you to hear that here your property rights are subordinate to “the greater good”.I know.I lost just such a case here.

I've had neighbor issues where they (anonymously) invoked the power of the (local) state to harass me for pushing 30 years now. In the last few years it became completely obvious just who it is. I had to go to court to get the popos straightened out on just what the law is (fortunately the judge seemed to follow the law and US Constitution) and am now working to educate the perps. It's a hassle, but now that I am temporarily retired, I have the time to pursue my legal rights without great expense.
In your case, it'd be good to read the local, state and federal ordinances/laws/bureaucratic pronouncements. My experience to date indicates that it is difficult to obtain more Justice than one is willing to pay for. It's best to stay away from the legal system as much as possible. Having the written law on your side is a plus though.

Thanks....
I am preparing for battle...thus the research. I have been told the law is on my side but one should never be overconfident ...just overprepared.
