Vanity: Can anyone point me in the direction of a good website to search information on property rights for land courted property in Cape Cod and rights to rebuild a home regardless of neighbors view changing on coast.Looking for case law, articles.... I'd appreciate any help. Thanks
Check the deed restrictions on the property and then check with a real estate lawyer on Cape Cod.
Ruger.com. But seriously, don’t’cha just love the ability of one level of government or another to either slow you down or stop you from being free?
Thanks.... ;)
No deed restrictions....just neighbors causing a fus.....they have big homes.....
Actually ...it is my neighbors...ARGH>>>>
But government in general is changing everything everywhere ....
I cringe at the implied restrictions, red tape, and general local idiocy of the cape building code and land use regs. Good luck.
I am looking at whether or not my neighbors can stop a rebuild even though everything looks to be okay for approval by the town. My neighbors are bringing attorneys to the next set of commission meetings.....
Thanks!
I think we might be in for a fight but not with the town....believe it or not.
The Cape does things very differently!
As long as you’re within the towns building codes you should be fine. Believe it or not the gov on the local scale is usually very reasonable and will toss aside idiotic complaints.
Forget all that. Before the next meeting, you need to figure out what kind of indigent minority you are.
Contact and question your town chairman, county clerk and local building inspectors for a listing of any local building codes/ordinances above and beyond you State approved uniform building code. “If you’re happy and you know it, clank your chains...(clank, clank).”
New plans approved by historic....we have 2 other commissions to go thruthen we go for permits. Neighbors have said it will change their views...they are not happy. They each have huge homes.
What other two commisions? Usually the historic commission has jurisdiction over views. Unless you have a "view commission".
I hope you are right. We have local people doing all the plans, etc. Everything has been a great experience except when 2 neighbors showed up yelling at the commission. Not so sure I want to live there now.....
Ha ;))
ZBA & Con Com
Oh, the Zoning Board may also have jurisdiction over views. Not sure what Con is.
You may have a fight on your hands. Views are actually considered value in some places. If they complain about the view perhaps you should bring up a view tax proposal to the town. (Yes, such things exist)
Also, it wouldn’t hurt to check with the state EPA to see if they have any restrictions re wetlands development. We had a few cases where the county allowed building and several years later the state came in and made the owners remove the structures (fortunately, they weren’t the houses themselves but rather outbuilding, fences).
