Frankly I don’t believe even you are stupid enough to follow your own advice.

You, an innocent person, come home and discover your child is missing amid indications of possible foul play.

I bet you IMMEDIATELY call the police.

I bet the first thing you do upon discovering your child is missing is NOT thumb through the yellow pages looking for lawyers to interview.

Yes, there are circumstances in which it makes sense for an innocent person not to talk to police without first obtaining legal advice. You are applying the “don’t talk to police” advice to circumstances in which it doesn’t make sense.

Let’s say you see a street thug kill a passerby and take his wallet, and then go running off in a certain direction.

Moments later a police officer pulls up and asks you if you saw which way the killer went.

Do you tell the police officer “I will not talk to you until after consulting an attorney?”

Only a selfish p.o.s. would not talk to the police in that circumstance.

The video of the law professor is not anonymous and the law enforcement investigator, who agrees, is not anonymous... :-) And they're both commenting professionally, from their own fields of work.

Oh..., and the Bill of Rights is not "anonymous" either... LOL...

To add some detail to your point, where he says he went, there are no woods. It’s the west desert. A lot of wide open, desolate places to dump a body, for sure, but no woods. And not much in the way of camping amenities, either. With the snow we’ve gotten, if he dumped her out there, not much chance of finding clues or remains until spring. And there is wildlife...

He claims he didn't show up for work Monday because he thought it was Sunday. He allegedly took the kids camping about 120 miles from their home. Police searched the area and found no sign of Susan, but fresh snow covered any indication that someone had been camping there. Still, it's hard to believe a dad would take kids ages 1 and 4 camping in the middle of the night, especially when temperatures are falling to below zero in the area. And since Josh claims he wanted to test out a new generator, he doesn't sound like the kind of camper who's into roughing it in bad conditions. Police nonetheless say he's not a suspect, though they expect to interview him further. Friends say the couple was having marital problems. Two years ago, they filed for bankruptcy in what appears to be a dual case of overspending and unemployment. Both have been periodically jobless in the past. And it seems money woes forced Susan to give up being a fulltime homemaker and go back to work. She was a stay-at-home mom when they filed for bankruptcy in 2007. At that time, Josh's profession was listed as realtor. But they owed more than $200,000 in credit card, furniture, student loan and other debts, suggesting they were living well beyond their means for such a young family with two small kids. No..., you line that up ahead of time, like a good citizen and one who plans ahead -- if one is smart, that is... :-)

If you look into these things, such as your Constitutional rights, you'll find out that it pays to know these things ahead of time and not try to do your "studying up" of them when something happens... LOL...

You'll have the name and number on speed-dial, already... :-)

The rule is to never talk to the police under any circumstances. That's the advice that any attorney who is competent is going to give you. But, when he's there, he'll also allow you to talk (or not) according to his advice. That's why you have an attorney -- if you need one.

And if it involves the police, you need one -- or else -- do not ever talk to the police.

No matter what an "non-professional" thinks... it's still the professional's advice (i.e., a lawyer protecting your rights, and also, you see the agreement from the professional police investigator that this is true) -- to never talk to the police.

If you are smart, you'll follow your own attorney's advice.

Let's hope you're smart enough to follow your attorney's advice.

I am 100% certain that in the circumstance I posited about the fleeing killer, that you, Star Traveler, would immediately tell the cop which direction the killer fled, and would NOT say, “Just hold on there a minute, officer, until I can get my attorney on my cell phone speed-dial.”

We are beginning to deal with hypotheticals that are not *missing family member* scenarios. However,this discussion and the video of the 5th Amendment protection are sobering lessons which, I pray, none of us will ever need.

Best pre-nuptial agreement:

If you or your spouse find your marriage unbearable - leave with grace and decency. Never ever, leave in such a way as to cause this type of grief and suspicion.

That is why I find it so hard to believe a mother of small children would have left the home without her infants, purse, cell phone & running to her parents for help.

You would be surprised at how quickly cooperation ends.

He: My wife has been missing since three o’clock, you have to help me find her.

Police: Okay, why did you kill her and where did you put her body?

He: What!? I didn’t kill her! She is missing! Find her!

Police: Did you kill her after an argument? Did she have a big insurance policy? Are you fooling around with some other woman?

He: What!? Are you insane? Why aren’t you looking for my wife?

Police: We will, as soon as you tell us where she is.

He: I need a lawyer.

Police: Oh, so you *did* kill her, huh?

(Later, to the media) Police: The husband is not cooperating with our investigation. However, he has made several incriminating statements of denial.
