Guess he never read the 5th Amendment:...nor be deprived of life, liberty, or property, without due process of law.
Also the Grand Jury Clause's reference to "capital... crimes". He'll be reversed faster than a Ninth Circuit ruling that's gone to SCOTUS.

Also can’t be sentenced to death without................... a hearing and fair trial. Texas has this leetle problem with false convictions and fradulent prosecutions. Not that that's what the judge cited in this case, but Texas's track record for fair trials isn't all that good.
