Post number 10 actually sounds pretty good.

There's also a good chance that if you show up with some sort of evidence - such as suggested - the cop's NOT going to be there, and the judge will dismiss rather than calling in you and cop for another date.

Were you just go in emptyhanded and plead not guilty, the judge or commissioner would probably rubberstamp another trial date.

If there was any law that might be abused for racial profiling it is this one.

Maybe I got stopped because I looked white, they had to balance out their diversity stop ratio

Just a suggestion: Besides preparing for your defense (I like the taking pictures suggestion), try to find some time, take an hour here and there, and go to traffic court and observe. This one thing really helped me on my traffic ticket. I think it gave me a lot of confidence and helped me know how to prepare for court. It’s such a foreign environment, it’s helpful to become more comfortable and to observe the judge’s demeanor and patience level.

Got it....then if I were you I wouldn’t tip my hand by “showing” any photographic or affidavit evidence; chances might still be good that a cop won’t be pulled off the street for a seat belt violation when you get the trial date.

I will take a look, I think the traffic court only hears cases on certain days. The one I am going to only gives out dates.

If it was me, I definitely bring the kids, at least the older ones. Have them testify (if you can call withnesses) even.

Why? Because if you will, they will see that justice can be served, but sometimes it takes effort. IOW, Freedom Isn’t Free.

If you lose, they will have a good example of “cops are NOT your friends” unless you REALLY need them and of corruption.

Good lessons either way, and frankly worth the $150 IMHO.

You know, the state is silly, it can’t possibly be worth it to tie up everyone in court for a 147 dollar ticket.

My rough calculation says that the ticket they wrote me will cost them about 2300 in the end. I am going to destroy anything they would make writing tickets the entire day.

I’ve been infracted for seatbelts several times now. Both times pulling out onto the road and then putting on the seatbelt when I come to the first intersection.

I’ve been driving now 12 years, have an accident free history.

Seat belts should be my choice to make. I understand the safety benefits of it, but the state shouldn’t be able to fine me for not wearing one.

I guess in my own convoluted way I was saying that they can stop you for not wearing a seatbelt. The original law (at least in NY) was they could only charge you with the seatbelt offense if they stopped you for something else such as speeding. The law has since morphed into they can stop you if they think you aren't wearing a seatbelt. Nobody objects to this arbitrary expansion of power.

Now with the immigration law, these same liberals who have no problem with the way the seatbelt law is applied, are screaming because if someone is stopped for an offense such as DWI or whatever the cops can ask you for ID to prove citizenship.

OK perhaps my example was a bad one, but my point is the Statist has no problems with arbitrary power when it fits his agenda, but if one of his "protected classes" is hurt then it's a big deal.
