Yup. I've stated before that I believe Lakin will not find justice in the military courts. This is a question that is out of their jurisdiction. I believe he and his civilian lawyer fully intend to loose there, and take his case ultimately to SCOTUS who does have the authority to answer this question.

This whole thing is about his eligibility. Not poor job performance or lying under oath about sex. If Congress did ever investigate his eligibility...and found that he was not eligible...they would confirm what we know. That he is a usurper. So, then, how does Congress impeach a usurper?

The people, by way of popular vote in an election, can not amend the Constitution. If they could, Arnold Schwarzenegger or Margaret Thatcher (for example) could be voted into the Presidency in 2012 and they would be deemed a legitimate President simply because a majority of voters "pulled the lever" for them.
