“embarrassment to Congress”

It is obviously not law. It is an opinion. It is a trigger phrase, a very good reason to appeal a case. It is the phrase that will be used to get it to the SCOTUS.

Dad says that the military court is a federal court and as such may be appealed to SCOTUS.

Yeah, but we now have 2 justices sitting on that court who have a vested personal reason to not let this case see the light of day.

THAT is precisely what I am hoping, but also I find the wording that it would cause embarrassment to Congress to assert that .... in the judge's opinion there is SOMETHING that WILL emabarress Congress, not "could" or "possibly" --- i.e., that there is MERIT to the allegations.......
