Please note a minor error: Executive Orders are *not* legislation, though they are one of the more offensive abuses of the “Imperial Presidency”, and as often as not are sounding boards of presidential mental health.
Even more troubling are Presidential Signing Statements, where the president effectively rewrites legislation by saying what parts he will enforce and what parts he will ignore, taking away congressional authority; and how he wants to “interpret” the law, taking away federal judicial authority.
As such, PSS’s are clearly unconstitutional and a threat, and must be stopped; and EO’s must be limited to directives for enforcing new and existing laws, not to promulgate new parts to the executive branch.

The bright side to that, is that it won't take a ruling by the Supreme Court to abolish this. A stroke of the pen by our next president, and it will be gone.
