Old Man Says Cop Beat Him for Trying to Help

Fairhope, Ala. (CN) - A police officer beat an elderly man who called 911 to report an accident and stop a drunken driver from leaving the scene of a crime, according to a complaint in Baldwin County Court.

Dorsey Henderson says he investigated an auto accident that happened across the street from his house. After determining that one of the drivers was belligerently intoxicated, he told the man not to leave and called the police.

When Officer Trent Scott arrived on the scene, Henderson tried to tell him what had happened and that he had put the driver under "citizen's arrest" because he was trying to leave. Officer Scott told Henderson there is "no such thing as citizen's arrest in Alabama," adding "get out of the way[,] old man."

While citizen's arrest is a gray area in Alabama, Henderson says he had "only been trying to help."

Nevertheless, Scott put him in an arm bar, tearing the man's rotator cuff, and walked him across the street.

When they were back in Henderson's driveway, Scott "slammed" the elderly man face first into the driveway, breaking his nose and his glasses. Scott "proceeded to beat" Henderson in "the back of the head, neck and arms." Scott did not arrest Henderson or charge him with any crime.

Henderson's wife, Dorris, watched from a wheelchair 18 feet away and called 911, saying that Scott was "beating the hell out of my husband." When the ambulance arrived, Scott sent it away, handcuffed the man and put him in the back of his patrol car.

Scott's superior showed up, released Henderson and called the ambulance back to treat Henderson and bring him to Thomas Hospital.

As of May 16, 2011, Officer Trent Scott was still employed by the Fairhope Police Department.

Henderson and his wife seek damages for constitutional violations. They are represented D. Keith Landers of Daphne, Ala.

That is so sad. That poor wife, unable to help her husband.

Typical cop on a power trip. Never initiate contact with the police. Many are either corrupt or are on a power trip. Every encounter with the police is a potential life threatening situation.

The police these days are digging themselves a DEEP hole.

One day, they are going to need ‘us’, but most people will just stand there and watch, as they are eaten by the ‘zombies’.

They would have brought that fate upon themselves....

Like they say, there is no situation so bad that it can’t be made worse with the addition of a cop on the scene. Not all cops of course, but getting the wrong cop is like winning the lottery in reverse.

did you ever watch Alaska State Troopers on the National Geographic Channel?

they treat the citizenry with ultimate disrespect and are elitist when it comes to the people’s constitutional rights....(If I ran the state police in Alaska I certainly would not want a reality show of this type, especially from what I have seen).

the word Nazis comes to mind when I watch that show....

The only time in my life I was robbed was by uniformed San Francisco police officers.

I don’t have tattoos, wear hip-hop clothing, and I don’t smart off to cops. I never drink and have never smoked pot.

Did I mention I also used to work for a PD...?

I was shocked to the core —I’m still shocked.

I’m sorry to say I believe this story completely.

Yikes. I wanted to see what this guy looked like and found this photo...when he was named Officer of the Month last November. Wonder what the runners up are like!

There are people who are constituted in such a way that they would make excellent policemen. The problem is that many of them are not drawn to the job. Then there are those who should never be policemen--kids who were picked on in school and want a chance to "get even", sadists, trigger-happy cowboy mentality losers who were refused military service for any number of good reasons. When they make the force, it's trouble (if not tragedy) waiting to happen, and it happens alot.

Such is life. A cop gets out of line with me, he'll get a real quick adjustment. I have family members who are (excellent) policemen. I have acquaintences (not really friends, but kids I grew up with) who are cops, but who never should be. I've heard some of them in the local pub bragging about committing felonies in court to convict some innocent person of a misdemeanor.

Once in a while, the Chief gets an anonymous CD with film/tape of the loudmouth imbecile(s) in flagrante delicto.

Such is life.

I reached that point when the Sherriff's Association here in Florida opposed Open Carry. If I ever witness some bad-ass dude beating the crap out of a police officer, my only dilemma will be choosing the f-stop on my camera. After all, I can't be trusted to protect myself with a firearm.

I think these facts are very relevant in that they make a strong case that we are getting an accurate picture of the incident.

The writer of this piece did a good job giving us enough information to form an opinion.
