The issue seems to be peddling condoms on the street without a license.
The vendor doesn't make the condoms. They are sold online at obamacondoms.com. I would worry about them working just as poorly as everything else with Obama's name on it has worked.

Actually, the issue seems to be in this paragraph:
"The arrest came despite a State Supreme Court justice ruling that his rubbers are protected by the Constitution's guarantee of free speech. The decision said that the condom wrappers should be treated like books, which do not require a vending license."
