They apparently claim that since they didn’t hit anyone, it wasn’t assault. Perhaps they were just expressing themselves.

Again, I don't understand! A semi-automatic rifle is an “assault” rifle because of how it looks, but firing a volley of rounds into a busload of people from these rifles is NOT “assault” because you miss (at least if your Holder's people)?
