If a country sheriff really does an investigation, and thinks there is evidence that a crime may have been committed (voter fraud due to ineligible candidate), can they issue an arrest warrant? Or must they get a judge to do so? Can a POTUS be issued an arrest warrant by county authorities (sheriff & county judge)......I’m not asking if they can carry it out, just if they can issue such a document?

Now let’s carry this “what if” scenario farther. IF such a warrent can be issued and was. Should the POTUS set foot in that county where the sherif has law enforcement jurisdiction....could he take said POTUS into custody? Could it go so far as his deputies arresting any Sercret Service or other federal entities that attempted to stop such an arrest...even to the point of using deadly force?

Where does a local sheriff stand in relation to federal authroities? Who can override a sheriff? Can the governor or a federal judge?

There are no federal elections, just federal election laws. So States hold elections for federal office (Congress) or for electors who vote for candidates (President and Vice President). The dichotomy becomes more absurd when one realizes that the same Constitution governing who may be POTUS is ignored when the States put party candidates on the ballot for the highest office. In 2008, a Nicaraguan was on the ballot in NJ, for example.

As we speak (write), the FEC issued a draft opinion in favor of an applicant for matching funds in the 2012 Presidential race, one Abdul K. Hassan, Esq., a naturalized citizen. Maybe the FEC is also now using Sharia Law.

Still, I’m really curious. Does a County Sherriff have the authority to issue or request an arrest warrant for a sitting POTUS? Of course, I realize that no other jurisdiction would extradite a POTUS.

I’m also wondering IF said POTUS coming into a County where he has an outstanding warrant....can he be arrested by the Sheriff. Can the Sheriff take down Secret Service agents to do so? Just how authority does a County Sheriff have while operating in his county? Does his arrest powers trump federal authority to “protect the POTUS”???

In light of the jurisprudence established in decisions such as U.S. v Nixon and Clinton v Jones and the text of the Constitution, while the president is not above the law and may be subject to civil suits from private citizens, nevertheless anything that is in the nature of a high crime or misdemeanor, such as fraud, may only be prosecuted against the president in the U.S. House of Representatives.

I think an indictment or information against the president issued by a grand jury or district attorney would be quashed on constitutional grounds. Perhaps it would be possible for the prosecutor to obtain an order of court formally referring the indictment to the Office of the Clerk of the U.S. House of Representatives or other proper office for whatever action the House may choose to pursue.

I think an indictment for a crime that is not considered a "high" crime or misdemeanor, such as a parking violation, could in fact be legally issued against the president.

There would be no constitutional restriction on issuing indictments against any other person involved in the fraud, such as aides to the president or state bureaucrats, and the president could be named as an unindicted co-conspirator.

I think I read somewhere that Sheriff Joe issued a clarification of his position on the Obama issue a few days ago: He told a local radio station that he was only going to see if he or some state agency had jurisdiction over the Obama eligibility issue and that is all he was going to do right now.

That is, he seemed to be emphasizing that in no way did he promise anyone that he was going to use all his power to investigate President Obama's eligibility to run for President.

I think his point was that anyone who believes that he promised anyone that he is going to do a deep investigation any time soon of President Obama's eligibility to run for President is wrong.

If a mentally unstable/unreliable near relative of Arpaio’s goes missing, I’ll bite on this one. Otherwise, from what I know by following MM’s blog for quite some time, is that Marizela had some mental issues going on, and that Michelle has, to my knowledge been consistently (some would say vehemently) “anti-birther”, even prior to Marizela’s disappearance. Sorry, I’m just not seeing Marizela (politically motivated) foul play angle here. Besides, Camelback Mountain isn’t even close to Fort Marcy Park.

I know the story is true. I just don't understand where Arpaio gets his jurisdiction over the matter. Isn't he pretty much responsible for crime in his county alone?
