That manager was a MAROON !!! Any idiot manager OUGHT to know the provisions of the ADA [I fault McDonald's for this too - AFTER ALL they DO have the PRESTIGIOUS Ronald McDonald University].

If you get to see a video of it - the woman CLEARLY has two special-needs kids in tow AND the dog is CLEARLY a Service Dog ...

McDonalds and the dumb manager have already lost the case.
Federal law requiring accommodations for people with disabilities in the community and workplace. The ADA banned discrimination against physically handicapped persons in employment, transportation, and public accommodations. U.S. Department of Justice Civil Rights Division will be handling her case. One more person joining the unemployment line, if not jail.

To top it off, the dog was probably cleaner and more disease free than any surface in the restaurant or any of the employees.

A company I know violated the ADA and terminated disabled employee without cause... but because his manager "just didn't like that durn accommodation nonsense...". It took him half a year and thousands of dollars just to get his job back. No payback for the expenses.

NO, these cases are not lucrative so ya'll can stop your lawyer/lawsuit bashing on this one.

Wrong to punch a customer - OBVIOUSLY!

BUT - don’t assume that because a dog is wearing a “SERVICE DOG” vest - that he really is a “Service Dog”.

You can buy a service dog vest for a few bucks. I can’t find it now but not that long ago I came across a report of how many people were buying “service dog” vests for their pooches so they could take them into stores and wherever they went.

Just like an aunt I have who filed a sexual harassment suit against her federal employee boss, to only split the take as they were both closing in on retirement, .........My guess is that the perfect no defense scheme is to beat down a person with a service dog as a fast food manager and then split the take.

Believe it or not, this is becoming a real problem! I’ve written other articles on this and even gotten some emails from readers with service dogs asking me to take them down due to their not agreeing with my opinions. But, the fact is, there are people out there that are taking advantage of the laws/rules for those with true needs for a genuine service dog.
Unfortunately, the ADA law states that a business owner cannot question or require proof that a dog is really a service dog. It’s against the law. Abuse of the Americans with Disabilities Act provisions concerning service dogs is increasing. People are buying fake service dog vests and certifications, and insisting on the right to take their non-service dog pets into stores et al with them. The Department of Justice recently updated Title II regulations on service animals to say that a public entity may ask just two questions regarding service animals: is it needed for a disability and what does the dog do? Documentation is not required.
In my opinion, that makes it rather easy for people who want to pass off their pets as service dogs, to lie. If I am interpreting the DOJ language correctly, it means that all a hearing person has to do is say “My dog is a hearing dog. My dog alerts me to noises that I can not hear.” Behavior is apparently the only clue that a dog is or is not a service dog. Real trained service dogs know how to behave.Read More

Did you see the video from the # 10 post? It explaines alot of what happened. She has a good case, With the manager’s pigment and gender and this so called Justice Department who knows how this will go?
