Just got off on the phone with a friend in the legal field and she says that a potential lawsuit against Random House by anyone of the Palin family involved in the "trash book" will most likely be quietly settled out of court because the idiot McGinniss opened up Random House to a whole lot of trouble and gives the Palin's an upper hand and GIFT in Court because McGinniss waived attorney client privileged between him and RH by talking about it to a third party (Jesse Griffin) and thus Palin's lawyers are entitled to ALL correspondence from Random House concerning the book.
My friend say that Random House may have a lot of leftists there and may hate Sarah Palin with a passion but its pure suicide for them legally to open up their correspondences in the "discovery phase"....they may have more damning info in those correspondence that was meant only for "Random House Eye's Only".
She said Random House and Jon Meachem may do a kabuki dance in the public defending the book and its "sourcing" on these false allegation but behind the scenes they will most likely quickly call for a settlement before the case got to discovery phase or even before the case is brought forth.
Legally, The Palin family has Random House and Joe McGinniss is a terrible legal bind.

So you are saying your and/or your friend feels that Palin will settle out of court for a large sum rather than pursue the case in court (which the lawyer feels she will win) and ALSO clear her name by doing so? Why? Just to save on the lawyers fees for the court case?

So Random House will be legally called Sarah House, right? It takes a lot of money to run the 2012 campaign so this would be an appetizer.

She could break Random House and McGinnis and teach all the PDS people a lesson. They were beginning to think they could get away with anything at all against her. Then they went waaayyyy too far thinking they were safe. Hahahahaha.

Your title is misleading. No suit has to be settled. Suits are settled when both sides view a settlement their best NET result.
This suit may be settled if Random House and the dumb author really has given the Palin’s the hammer that it seems. As Mark Levin said tonight, the dumb author has pierced attorney client privilege with which ever attorneys he was referring to in his e-mail. That means the lawyers are open to discovery and testifying under oath. Random House may well try to buy their way out of having their attorneys deposed.
The problem that I see is that our politics have reverted back to a base level that would make the Roman Republic look classy. We are having a internal cold war and it’s about to get hot.
In such a settlement whether winning the court case or just settling it before it goes to court ....the book will be pull, RH would most likely have to declare the allegation are false and a settlement payment will be dealt.
That’s basically what going to happen whether they win or settle it - its the same results

True or not, if it were to go to court, a lot of stuff that did not appear in the book could be perused publicly.

1. It is almost impossible for a public figure to win a defamation lawsuit.
2. Truth is an aboslute defense to defamation. That means that SP and Todd can get deposed about their marital life. Glenn Rice would also be deposed.
Filing a defamation suit would be the worst thing the Palins could do.

It’s not clear that the book has damaged her.
I vote no on suing. Lawsuits take over your life and not in a good way.
