On July 13, the defense team filed a Verified Motion to Disqualify Trial Judge. Judge Lester responded on August 1 by issuing an Order Dismissing Defendant's Verified Motion to Disqualify Trial Judge on the basis that it was legally insufficient. Today the defense team will file a Petition for Writ of Prohibition with the 5th District Court of Appeal.
What does this mean in English?
O'Mara believes the trial judge should be disqualified. The trial judge disagreed. O'Mara is appealing that decision.
The formal title, "Petition for Writ of Prohibition," means he is petitioning the appeal court to issue an order that prohibits the trial judge from continuing to hear this case.

A writ of prohibition is a writ directing a subordinate to stop doing something the law prohibits. In practice, the Court directs the Clerk to issue the Writ, and directs the Sheriff to serve it on the subordinate, and the Clerk prepares the Writ and gives it to the Sheriff, who serves it. This writ is normally issued by a superior court to the lower court asking it not to proceed with a case which does not fall under its jurisdiction.
These Writs are issued as “alternative” or “peremptory.” An alternative Writ directs the recipient to immediately act, or desist, and “Show Cause” why the directive should not be made permanent. A peremptory Writ directs the recipient to immediately act, or desist, and “return” the Writ, with certification of its compliance, within a certain time.

If I were Zimmerman's lawyer O'Mara, my first line of courtroom defense would be that GZ was packing a Kel-Tec. As is well known in gun circles, you cannot actually shoot someone on purpose with a Kel-Tec. They only fire accidentally. Occasionally, they are known to "cook off," but rarely on cool rainy nights.

I was feeling very good after hearing that presser lawyer O'Mara gave. He just seems like the kind of guy who can get it done. I am thinking that this "Self-defense Immunity Hearing," which is GZ's by statutory right is what will keep both sides happy.
The prosecution having thrown a bone to Obama and Holder's People, can go with the obvious facts of the case in a non-trial (read quiet) hearing. And, by the time it happens 7-8 months down the road, this ridiculous case should have cooled off, particularly with a new AG on the job.

Chances are pretty good. Even the judge himself kinda alluded to getting overruled by a higher court when he refused to recuse himself
This judge, Angela Corey, Gov Rick Scott, AG Pam Bondi, and all the Black Racist “leaders” are all responsible for this lynching. I will do everything possible to make sure all the elected people involved are voted out (I can vote out Lester, Scott, Bondi). This is an absolute travesty that Zimmerman is being tried when the Black Ghetto thug Trayvon Martin ATTACKED Zim.
The judge should be jailed for his bias.

This case does seem to be kangaroo court-ish. A legal conceal carry, attacked by this punk clearly what Stand Your Ground is all about and the state keeps trying to pull this.

Lester is a liberal emo who has been swept up in the spirit of political correctness, department of race baiting whitey, division of hatin’ guns. He finds himself refereeing a political trial with second amendment advocates on one side and his liberal political tribe on the other side. He's not handled the pressure well.
