Let's say Obama signs it tomorrow. Who would challenge the legitimacy of the law on the technicality? The cowardly and pathetic Congress would shrug like they did when he blatantly ignored the War Powers Act in Libya. The Surpeme Court under Roberts would just say "elections have consequences" and ignore it. Obama answers to nobody at this point, it seems.
Honestly, if the house hasn't been willing to say "if the Senate won't execute its constitutional responsibility to pass a budget, we won't authorize funds to run the government" for four years now, when do you think they will ever grow a spine?

That’s not how a pocket veto works. A bill is only “pocket vetoed” if it is not signed within ten days of being passed by Congress AND Congress is not in session after the tenth day. Simply failing to sign legislation before Congress adjourns does not mean that the legislation is “pocket vetoed.”
