I get your point. But “property” as you call it has a value. To place a 100,000 dollar value on nude pics being stolen is ludicrous.

Punitive damages are relative to the entity that is found guilty (liable) for the damage. It's punishment payment. I don't normally agree with punitive damage awards (like HOT McDonalds coffee). But the OJ Simpson Civil Trial seemed to fit the reason punitive awards exist. Precisely when no tangible value can be attributed to a loss, in this case personal private data. In the Simpson Civil Trial the damages were for what, that value of Nicole's life?

Personal photos are property per copyright law.
