How could anyone identify the plant based on that picture? There might be some in my back yard. Who knows or cares?
The states have never amended the Constitution to make smoking anything an expressly protected right. It’s ultimately up to a state’s voters to exercise their 10th Amendment-protected state powers to decide if you’ve got a “right” to smoke a given substance in their state.
