The Obama administration has a new solution to force compliance with the Affordable Care Act (ACA): simply ban businesses from reducing staff in response to the law’s burdensome employer mandate.

The administration previously postponed the law’s requirement that all businesses with 50 or more employees provide health insurance until 2015, a year later than required by the ACA. In what is being referred to as “transition relief,” the administration’s latest delay of the employer mandate through 2015 exempts mid-size businesses with 50-99 employees from the requirement, and lowers the requirement for businesses of 100 or more employees from 95 percent to 70 percent staff coverage.

Given the costs of insurance, businesses with just over 100 employees have a strong incentive to reduce staff below 100 and take advantage of the exemption. In a tacit admission that the ACA pressures businesses to cut workers, and perhaps to stall further criticisms, the IRS recently released regulations specifically barring employers from reducing staff or hours as a result of the ACA’s employer mandate.

If nothing else, law firms will make a lot of dough litigating this. I suspect it will grind up to the Supreme Court.

Split your 102 person company into two companies of 51 each. in 2015 take 17 from each of your two companies and form a third company. You now have three companies of 34 each. Workforce does not have to be reduced. No harm, no foul.

Or better yet, go all 1776 on the @holes who try to enforce this abomination!

Gee, glad we did not do that and instead downsized due to economic trends and to become and leaner and more profitable company............

The book of Daniel speaks about the coming evil one and he will “think to change times and laws”. “speak great words against the most high” - Obama rebukes God in most every action he takes. A time is one year, a times is two years, and the dividing of time is 1/2 year. That makes 3 1/2 yrs. he has a strangle hold on the saints (those who believe in God - Christians). It says he is “wearing out the saints” and he is surely wearing out every Christian with his unholy actions.

“Daniel 7:25 And he shall speak great words against the most High, and shall wear out the saints of the most High, and think to change times and laws: and they shall be given into his hand until a time and times and the dividing of time.”

Directive 10-289 (May 1, 2019), in Ayn Rand’s novel Atlas Shrugged, was an Executive Order drafted by Wesley Mouch, with the willing participation of James Taggart, Orren Boyle, Clem Weatherby, Floyd Ferris, and Fred Kinnon, and signed by Mr. Thompson, Head of State.
