San Francisco DA Declines To File Charges Against Man Who Fatally Stabbed Dodgers Fan

SAN FRANCISCO (CBSLA.com) — The San Francisco District Attorney on Friday announced that they were not filing charges against a man for fatally stabbing a Dodgers fan last year.

Jonathan Denver was stabbed by Michael Montgomery in September 2013 during a bar brawl following a Dodgers-Giants game.

The DA — George Gascon — said after an extensive investigation, including an interview with Denver’s brother who participated in the fight, members of Montgomery’s group and independent witnesses, that he could not prove beyond a reasonable doubt that Montgomery was not acting in lawful self defense.

Conceding Denver’s family “suffered greatly and will never be the same,” and “our hearts go out to the victim’s family. The loss of a loved one in this manner is indeed tragic” Gascon said in a statement, “We worked very hard to see if there was sufficient evidence to charge the case.”

The DA said it remains unclear “how the fatal encounter started, [but] what the evidence shows was a physical confrontation between the victim, the victim’s brother and Mr. Montgomery. The totality of the evidence revealed that during the physical confrontation, Mr. Denver punched Mr. Montgomery. At, or near the same time, the victim’s brother, swung a collapsible aluminum chair at Mr. Montgomery striking Mr. Montgomery in the head.”

Gascon’s statement added, “Both the victim and his brother substantially outweighed Mr. Montgomery by 50 and 100 pounds respectively. Under these circumstances, Mr. Montgomery inflicted a single stab wound that tragically proved fatal.”

The DA concluded, “We are ethically obligated to decline to prosecute this case.”

Good call. This was not like the Brian Stowe beating.

The survivor was not at a baseball game. He and another friend and their dates had attended a music event. One happened to be wearing a Giants cap.

The drunken Dodger fans in SF used his wearing the Giants cap to initiate hostile overtures.

The dude was on a date and drunken morons attacked him.

So like if I don’t like somebody in a green shirt on St. Patrick’s day, it’s his fault cause he’s initiating hostile overtures?

You’re not entirely wrong, it does incite hostile overtures, but really now should it?

As a lifelong Red Sox fan who's attended several Sox-Yanks games at "the Stadium" I've always known that the Bronx DA would never bring charges against a Yankee fan who stabbed me there.

And the reverse is true for the Suffolk County DA considering the stabbing of a Yankee fan. ;-)

There's more hate than love in *that* love/hate relationship.

I’m showing my age, but I used to have a New York Giants Baseball shirt when I was preschool age.

The San Francisco Giants originally were known as the New York Giants, the team moved to San Francisco in 1958.

Thank goodness the person stabbed wasn’t black. They’ve got special privileges. They would have had prez. obamar, rev. jesse, and rev. al Sharpton all coming down for the event.

Sadly, you know what I posted is true.

I try to treat everyone the same. Honestly, I think I try even harder to help black families when I can. I recently hired a black man to do some work for me. I was CHEATED out of a few thousand dollars and now I’ve got to hire someone else to do the same job. It certainly isn’t fair to others to be mad at them but this particular one certainly deserves my dislike. Obviously, I am mad at myself for allowing someone to take advantage of me.

I guess being mad at myself today allowed for a little tunnel vision. You were right. My post didn’t really apply very well to the article.

I will try to do a better at directing my distrust and anger to only those that deserve it. I don’t like being cheated but I believe the best thing for me to do in this case is to just get over it.
