Because the federal government has no constitutional power to ban them. Just like it didn't have any constitutional power to ban alcohol.

Actually, they DID have the power to ban alcohol, by Amendment to the US Constitution.
The fact that they couldn’t enforce it was the prime driver in the rescission of that Amendment.
