A rural northwest Iowa man who suffers from Parkinsons disease has filed a federal lawsuit claiming that he was brutally pummeled by a SWAT team after a relative made false harassment allegations against him
Instead of speaking with the retaliatory relative, the sheriffs department in Pottawattamie County, Iowa (pop. 92,913) sent close to a dozen members of its SWAT team to the home of John Hytrek.
Hytrek, 52, was working on a tractor in his driveway when the heavily armed policemen jumped out of a van.
He had previously warned the relative, who sports a prior conviction for uttering false statements, to leave his property.
According to the lawsuit, the horde of cops tackled the 52-year-old Parkinsons sufferer. His face slammed on a tire machine. The police officers punched him in the head at least five times.
I did not resist them, nothing, Hytrek told the station. They couldve came up to me and asked me what was going on, and they didnt.
The lawsuit also alleges that the SWAT team positioned a sniper across the street to monitor the situation in case the quinquagenarian man with a degenerative disorder of the central nervous system tried anything squirrely.
In a deposition for case, an unidentified deputy told Hytreks attorney Tom Prickett that Hytrek hadnt threatened the SWAT team in any way. However, the SWAT team members were concerned that he might brandish the hammer he happened to be holding as a weapon.
Hytrek suffered serious injuries as a result of the melee so serious that the SWAT team had to send him to the hospital before he could go to jail.
A judge dismissed the false charges against Hytrek for harassment and assault in November 2012.

If 52 makes you an old man than I should be dead.
I move the line that I consider “old” the older I get.
I wonder if any of these SWAT members ever ask, “Is this really necessary?” or are they all punks?
Whether he was 32 or 52 that level of force was clearly excessive.
This just goes to prove that when law enforcement is militarized they aren’t going to just let their toys collect dust.
The smallest hint of danger without little or no evidence to support it will lead to a full SWAT response.
Those officers involved should be prosecuted.
No military toys for LEOs of any kind. One SWAT team.per county sherrif’s office.
Right. At 73 I only occasionally refer to myself as old. At 80 I am sure I will fit the category. Just give me a few more years. I am sure old will catch up to me.

That is not a real large county population. I do not know if the Sheriff is up for reelection this year or not, but this kinda makes me wonder if maybe Mr Hytrek is supporting the wrong guy this year or maybe supported the wrong guy in the last election.

When local police are targeting returning military HEROES as TERRORISTS, they are way beyond any legitimate role.
These sheriff’s deputies officers ought to be facing criminal charges of aggravated assault, but since prosecutors in most jurisdictions have become enablers of this sort of criminal behavior, this farmer had to resort to Federal civil court. I hope that he at least gets a new tractor out of the deal.

What is the use of having a SWAT team if you can’t use them to attack dangerous people like this guy?
