What if Obama disobeys the law on another Gitmo release?
Washington Examiner ^ | 5 June 2014 | Byron York

We've all heard that the law requires the administration to give Congress 30 days notice before releasing prisoners from the U.S. terrorist detention facility in Guantanamo Bay, Cuba — a provision the White House willfully ignored in the recent release of five Taliban commandos in exchange for Army Sgt. Bowe Bergdahl.

(snip) The president will act as he chooses, no matter what Congress wants. The next Guantanamo release could make the Bergdahl battle seem tame.

What if Obama disobeys the law on another Gitmo release?

It will be no different than any other time he has disobeyed the law. The Republicans will do nothing about it.

Pretty much.

THIS is why we need a SCOTUS decision on this. We have accepted Signing Statements for decades. The first, I believe, to use it was Monroe.

So screaming now is a good thing, but we need to remember history so someone will get this matter before the Courts. The Constitution is silent on the matter. No, that alone is not enough as since Marbury the Court has claimed the right to interpret the Constitution as it sees fit and, Conservative or Lib or in between they all have gone beyond “original intent”. Don’t let anyone fool you. They all do it.

So what do we need here? A ruling.

A real leader in Congress should stand up and publicly tell the military not to do it. Its unconstitutional.

I would like to see a Constitutional crisis.

Then he needs to be frog-marched out of the White House between a pair of Federal Marshals.

timing? I suggest right after the elections, in the dead period that follows, and right around Christmas time, when most of Congress leaves town

The media, after some minor confusion and a couple of heretical articles, seems to have gotten its act together with this Yahoo story, "Smarter Than You Think" in praise of the brilliance of Obama's foreign policy. The meme now is "Reagan negotiated with terrorists too".

“What if Obama disobeys the law on another Gitmo release?”

Nothing. Congress has already ceded ALL of their power to Obama by refusing to impeach him the many other times he’s already broken the law. Congress has demonstrated that the only thing important to them is to be re-elected so that they can continue to enjoy the D.C. perks of fancy free meals, free NFL tickets, free foreign travel, hobnobbing with their billionaire masters, and receiving the adulation of the masses who’ve been deluded into thinking Congressmen are special.

Obama is now emboldened to do whatever he wants with impunity, and he’s going to continue to act that way until the end of his term, and Congress will do nothing. I predict that roughly every six months for the rest of his term, Obama will up the ante with more and more and bigger and bigger illegal behavior. And no one will stop him. He’ll be near an absolute dictator by the end of 2016.
