Chicago man faces murder, kidnapping charges two years after exonerated for 1980 murder Two years after Andre Davis was exonerated of a murder for which he served 32 years, the 53-year-old Chicago man was taken into custody and charged with the murder and kidnapping of a 19-year-old.

A Chicago man who spent 32 years behind bars for rape and murder before being exonerated by DNA evidence in 2012 is now facing new murder charges. Just 15 months after Andres Davis' release from a maximum-security prison in Illinois, authorities say the 53-year-old ex-con shot and stabbed a man following an argument at a party, the Chicago Sun Times reports. The body of 19-year-old Jamal Harmon was found in an alley in October 2013 after suffering three gunshot wounds to the face, lower neck and left armpit. He was also stabbed four times. Davis was charged Thursday with kidnapping and murder in Harmon's death and held without bail.

Alternatively - he was completely innocent, and being inside a maximum security prison for 32 years changed him.

There was a TV special about this. Seems back then they used instruments on dead bodies without proper cleaning between uses. DNA was spread all over the collected samples, particularly the under-fingernail scrapings. They had no idea that those small amounts of DNA could be used later.

Now the defense groups are going after these trace DNA (cross-contaminated) as evidence that someone other than their client committed the crime.

Not many details, but just because someone’s DNA is not on or near the victim, doesn’t mean he did not commit the murder, yes I think too much credence is put on DNA.

All other evidence it seems is disregarded in lieu of DNA.

  1. He was innocent of that and all other crimes.
     
  2. He was guilty of that crime but the evidence used to convict him was bad.
     
  3. He was innocent of that crime but had committed others, so was a logical suspect.
     
  4. He was innocent of that crime but became perverted in prison.

It’s a scam. See my post #3. These groups are USING the system. Repeated time and again. Advocate group samples 30 year old evidence for DNA from samples that were not properly collected based on DNA protocols for today’s technology. Find DNA not their clients. Judge orders new trial based on new evidence but prosecutors won’t retry since all the witnesses are either dead, moved away or can’t remember details after 30 years. Dude walks. Probably gets hundreds of thousands in settlement.

I think both Maurice tucker and andre davis were involved in killing the girl. they were both there drinking. davis made incriminating statements to roommate.
