Drunk Driver Sentenced to Spend Victim’s Birthday in Jail

A Waupaca County woman who struck and killed an 18-year-old man will spend his birthday in jail, as well as the anniversary of the day she hit Dylan and every Christmas Eve and Christmas Day, for the next 10 years.

A judge sentenced 40-year-old Heather Schmidt on Wednesday for the death of Dylan Thorne three years ago.

Prosecutors say Schmidt’s blood-alcohol level measured twice the legal limit after she hit

Sorry, but drunken driving that causes the death of an innocent should be treated as MURDER.

I think that you could treat them the same as other accidental but negligent killings. There are hundreds of ways to make poor choices with an automobile, other than intoxication, that can kill someone. Killing by driving while tired leaves someone just as dead as drunk driving accidents.

The sentence sounds unusual to me and likely to be overturned on appeal.

I can agree with your premise, but....

When you drink, then drive, you are premeditatively deciding to do something dangerous. If that results in the death of another, it’s not negligence - it’s murder.

However, I think that just plain drunk driving (where there is no accident or death) is treated far too harshly.

And just 40 days in jail, for a fatality???

WAY too lenient.

This happened in Wisconsin, I guess the judge just wanted to make her feel bad. SMH.

We should ban this dangerous drug.
