here is my advice; don’t seek legal advice on an internet discussion forum.
Normal procedure in many fields, no notice to prevent sabotage.
You may be correct. Not a lawyer. Your argument makes sense. That’s why I suggested he see a lawyer. Most, myself included are guessing at best.
I worked for Gateway. Was told to gather in the cafeteria for a meeting. Was told the company was closing, and we were fired. That quick. Oh, and when we went back to our desks, the pcs were offline, you we’re not going to get s*** from thoses pcs. There was a box on the desk, pack your s*** and leave the building. That was it. Took all of five minutes.
The answer is really clear. It is not his property. It is the property of someone else.
At this point it is not the property of the person that owes him the money. It is the property of everyone else that is left being owed money in the situation.
He has no right to steal that property.
Make whatever excuse you want to justify stealing but it is theft all the same. Don’t be a thief is always a good way to live.
Is his honesty worth nothing more than the value of a used laptop computer?
If you’d read what I said carefully you’d see I said to try and return it.
But you can’t return an item if nobody is there to take it.
Send an Email, ask, find out who to return it to. I am assuming that if the company is closed the door is locked but Email may still be answered. If you do return to make sure to get a signed receipt.
If you make a good effort then there is nothing more to do.
Bingo. It's called 'doing the right thing'.
A simple exchange between me and my father when I was young has given me guidance for many, many years:
Dad: "Does that belong to you?"
Me: "No".
Dad: "Then leave it alone."
Unpaid hourly wages have first claim in almost any bankruptcy case. That can be a growing claim as well; depending on the locality, employers generally have 72 hours to pay final wages including commissions. Penalties for not completing final payment within that period can mean up to an additional 30 days of wages will be owed.
Get a thumb drive or USB external hard drive, download all of the personal info and files, and return the laptop (get a receipt for the return).
That will save future problems.
Laptops are relatively cheap, from around $250 up.
(Worked in the P. C. hell called Human Resources for years.)
Me, too ;-)
Did you feel like a turd in a punchbowl, with all the PC worship going on around you? I almost couldn’t stand it!
Too much missing information and bad English. Try to slow down and write a coherent description. Otherwise, no advice you get will be worth a hill of beans because it is not based on correct information.
I had a great bunch of colleagues, but the top two admins, the board (far left and reactionaries), and a hyperactive legislature gave me fits. Retired early. No regrets. I’m sure I increased my life span.
