A Stonecrest woman was arrested after she allegedly entered the vehicle of a man who was eating breakfast Wednesday morning at Darrells Diner in Summerfield.
The man said he saw 54-year-old Valerie Jo Marra sitting on a bench out in front of the restaurant, according to an arrest report from the Marion County Sheriffs Office. While he was eating breakfast, another patron patron advised him that Marra had moved from the bench. When the man went outside, he found Marra in his vehicle attempting to take a pack of cigarettes from a carton. When confronted, Marra handed him back the cigarettes and took off on her scooter.
He then went to Murphy gas station at the Wal-Mart in Summerfield and he spotted Marra on her scooter and saw that she was attempting to enter a car in the employee parking section.
She was arrested on charges of burglary and petit theft. She was booked at the Marion County Jail. (snip)

On top of a sad story about an obviously troubled person, the way this story was written leaves a little to be desired. Very awkward IMO.

You know, I read that story, and I see a picture like hers, and I realize something:
There is some pathetic guy somewhere that actually probably hits “it”, as sad as “it” is.
Sometimes realizing stuff like that makes me wish everything would go Law of the Jungle mode so that the unfit could be weeded out again.

She needed cigarettes and saw that this man had a full carton — more than his “fair share” — so she decided to spread the wealth a little. Obama would be proud.

Classification and Penalties for Theft in Indiana
Prosecutors in Indiana have the discretion to charge most theft-related offenses as either “conversion” (a Class A misdemeanor) or theft (a Class D felony). (Ind. Code Ann. § 35-43-4-2, § 35-43-4-3).
Unlike many other states, Indiana does not make any formal distinction among theft offenses (conversion or theft) based purely on the value of the property.
Indiana law also establishes advisory sentences for each level of felony offense. An advisory sentence is a guideline sentence that a court may voluntarily consider, which falls midway between the minimum sentence and the maximum sentence for the offense. (Ind. Code Ann. § 35-50-2-1.3.)
Lets take a closer look at the different levels of theft-based offenses in the state of Indiana.
Class A Misdemeanor Theft in Indiana. There is no “petty theft” statute in Indiana. Rather, Indiana law refers to this level of theft offense as conversion, which is a Class misdemeanor. A person who commits a Class A misdemeanor may receive a term of imprisonment of not more than one year, as well as a fine of not more than $5,000. (Ind. Code Ann. § 35-50-3-2.) The court may suspend any portion of a Class A misdemeanor sentence. (Ind. Code Ann. § 35-50-3-1.)

This was in Florida that does have a petty theft statute and calls it “petit theft”.
