The guardrail didn’t cause the accident.
There has been a know defect with these guardrail ends since prior to 2005. The manufacturer has made changes in secret because they know they have an issue. That was discovered by a different manufacturer. All states DOT know of this defect. The manufacturer has settled out of court numerous times.
So while technically correct, the state shares some of the blame.
And the car, all by itself didn’t just decide to drive into the guardrail. I despise how the media writes this as if the inanimate object decided to crash on its own, like it’s a driverless thing.
