A Manhattan woman lost her bid to gain shared custody of her ex-partner’s adopted son, despite a groundbreaking ruling by the late Court of Appeals Judge Sheila Abdus-Salaam that redefined parenthood in New York.

Abdus-Salaam wrote the decision in the seminal case, Brooke S.B. versus Elizabeth A., in August, before she died of an apparent suicide earlier this month.

The ruling — hailed as a major victory by the LGBT community — says that non-adoptive and non-biological parents can still sue for custody.

“Where a partner shows by clear and convincing evidence that the parties agreed to conceive and to raise the child together, the non-biological, non-adoptive partner has standing to seek visitation,” Abdus-Salaam wrote. The decision was the late judge’s most famous case.

Businesswoman Kelly Gunn was the first to sue under Brooke last fall when her photographer ex, Circe Hamilton, tried to move to London with the boy. Gunn claimed she had a right to share time with the 7-year-old, whom Hamilton had adopted from Ethiopia after they broke up in 2011.

But Manhattan Supreme Court Judge Frank Nervo ruled Friday that Gunn didn’t have an “unabated plan” to adopt and raise a child with Hamilton. Even though the women had discussed adopting a child together, by the time Hamilton went through with the process, she and Gunn had already split up, Nervo found.

He added that Gunn stated “on numerous occasions that she did not want to be a parent.”

first of all, I don't want moslem judges...don't trust them...

secondly, what a stupid waste of tax payer money to run this thru the court...

so jilted gay woman wants to get back at the one who did the jilting by going after her newly adopted son....

this is a crazy world....

well that opens a whole can of worms. Ex boyfriends and girlfriends can force themselves into their ex's lives for e-ver by going after their ex's children?

The Court of Appeals' decision applies only when “a partner shows by clear and convincing evidence that the parties agreed to conceive a child and to raise the child together.” So, limited but doesn't stop exes from trying.

One thing you can say for the late Judge Abdus-Salaam, she didn't try to institute Sharia law.

A judge in deep depression should not be sitting on the bench. If clerks and other judges note the problem they should be removed.

A judge’s role does not include setting social policy. I’m sick of attorneys foisting evil on society. If her guilty conscience got to her, good.

The only evidence she was depressed — aside from an anonymous source in news accounts — is that her body was found floating in the Hudson River. She was a sitting judge who was not on leave. She called in sick on Tuesday, and she did not call into her office on Wednesday -- by the evening of which she was spotted in the Hudson. The frequency of physically healthy, 65 year old, fully employed, married women committing suicide is extremely low. Add to that, there are few places -- name any, really -- in Manhattan to jump into water so that you'd be sure to end up dead — as opposed to paralyzed — without highly visible to the public. Yet, no one saw her jump.

My points are, the autopsy has no yet been conducted and her husband of only ten months has not been quoted. This is out of a Law & Order episode.

Poor child. Bad enough he has all that baggage from Ethiopia but this as well.

This wicked generation is filled with raging lust, perversion, pride, and selfishness. They have seared their consciences with a hot iron and can no longer tell good from evil. Their perversion has desensitized them to the pain and hurt they are inflicting on others such that they are capable of demonic acts of torture even on children and unborn babies.

They also do the opposite of what Christ said about letting children come to Him. They lead children away from Christ.

The principles of hell are at work in them. As followers of Christ lay up treasures in Heaven, the wicked heap up treasures of wrath which await when God judges the world:

Romans 2:5
But in accordance with your hardness and your impenitent heart you are treasuring up for yourself wrath in the day of wrath and revelation of the righteous judgment of God.

Those who do not put their whole-hearted faith in Christ and persevere in their faith to the end, will die in their sins. And these sins will be judged as lost souls find themselves in a hell of their own making.

Their lusts and perversions will form instruments of torture by which they remain in agony forever.

Sin will remain with the sinner forever:

Revelation 22:11-12
He who is unjust, let him be unjust still; he who is filthy, let him be filthy still; he who is righteous, let him be righteous still; he who is holy, let him be holy still. And behold, I am coming quickly, and My reward is with Me, to give to every one according to his work.

The desire for sexual gratification through perversion will burn within the soul of the damned in hell. But it will remain forever unsatisfied. The longing for pleasure from drugs and intoxication with alcohol will still be there but unsatisfied. The rage of hatred and wrath will seethe inside these lost souls, but they will be no longer able to curse or commit acts of violence. It will be turned inwardly into depression and deep, hopeless despair. For there will be no remedy for their condition.

Even the smallest, most trivial means of satisfaction, which we take for granted, will be denied to the impenitent sinner in hell. As Jesus taught how that the rich man lifted up his eyes (windows of desire) in hell, being in torment, and desired to have but one drop of water—a request which was denied. Jesus taught that in hell, the worm would never die, and the fire would never be quenched.

The residents of hell will plead forever that they have learned their lesson, with promises of turning over a new leaf and changing. But they will have forever excluded the possibility of change, for they have rejected the one and solitary remedy for their sins which is the cross of Jesus, which is made efficient to us by the resurrection power of the Holy Spirit.

The doom and perdition of these lost souls will be infinite and with no relief, but saints will not pity them. Saints will rather be eternally grateful for their deliverance from such a horrific fate.

This is the eternal destiny of those who reject Christ’s redemption.

Do you not know that the unrighteous will not inherit the kingdom of God? Do not be deceived. Neither fornicators, nor idolaters, nor adulterers, nor homosexuals, nor sodomites, nor thieves, nor covetous, nor drunkards, nor revilers, nor extortioners will inherit the kingdom of God. And such were some of you. But you were washed, but you were sanctified, but you were justified in the name of the Lord Jesus and by the Spirit of our God.

Let mankind be warned of the day of wrath which is fast approaching, and avail themselves of the cleansing and transforming power of God in Christ before it is too late.
