Yes, you are correct. As long as the cop says he was reaching in his waistband, I thought it was a gun or he had a gun, he gets off in court. I think the cop needs to see a gun for sure. If he was unarmed. if he had a phone instead of a gun, or it never left his pocket, it should be manslaughter or 2nd degree for the cop. Like a previous poster said- the cop had a duty to protect his rights as well. It doesn’t matter if a person is on drugs, a long term criminal or has warrants, that does not justify killing someone. I know it can be dangerous for the cop, but he can quit anytime he wants too. Danger goes with the job.
