Go to the Daily Caller article and scroll down to red text that says Cobin's Court Records in red. Click on this text and it will take you to the actual police intake form pdf file. Mr. Pepperballs was actually arrested and charged with three counts of CLASS THREE felony aggravated assault.
From the arrest form the charges read:
"3 Cts. 13-1204A8A AGG ASLT-OFFICER F3 1 Cts. 13-2902A2 UNLAW ASSEMBLY-REFUSE DISPERSE M1"
In the Probable Cause description of what the perp did, here is some of the narrative from the form:
"ON 08/22/2017...... ANNOUNCEMENTS WERE MADE TO WARN A LARGE GROUP OF PROTESTERS TO DISASSEMBLE AND TO LAWFULLY LEAVE THE AREA. THE DEFENDANT WAS SEEN RUNNING BACK AND FORTH IN FRONT OF THE POLICE LINE OF OFFICERS, DISRUPTING THE CROWD AND BEING GENERALLY UNRULY AND CLEARLY REFUSING TO DISPERSE AND REFUSING TO DO SO IN AN UNLAWFUL MANNER. THE DEFENDANT WAS ASSEMBLING WITH TWO OR MORE OTHER PERSONS AND ENGAGING IN CONDUCT CONSTITUTING A RIOT AND KNOWINGLY REMAINING THERE AND REFUSING TO OBEY THE NUMEROUS AMOUNTS OF OFFICIAL ORDERS TO DISPERSE, THUS MEETING THE ELEMENTS OF AN UNLAWFUL ASSEMBLY ACCORDING TO ARIZONA REVISED STATUTES. AT 2036 HOURS SECURITY CAMERA TIME STAMP IN FRONT OF 222 E MONROE, THE DEFENDANT WHO WAS WEARING A GAS MASK KICKED A SMOKING CANISTER TOWARD FULLY UNIFORMED POLICE OFFICERS. AFTER KICKING IT UNSUCCESSFULLY, THE DEFENDANT PICKED UP THE SMOKING CANISTER, AND THREW IT TOWARD THE LINE OF FULLY UNIFORMED POLICE OFFICERS. AT THE SAME TIME STAMP ON THE VIDEO FOOTAGE, THE DEFENDANT THREW A SECOND SMOKING CANISTER AT FULLY UNIFORMED POLICE OFFICERS. LATER, AFTER RUNNING IN FRONT OF THE CROWD THAT WAS MOVING BACKWARD, THE DEFENDANT WAS SEEN KICKING A CANISTER AT UNIFORMED POLICE OFFICERS. AT THIS POINT, OFFICERS DEPLOYED AN IMPACT OC ROUND TO STOP THE DEFENDANTS CONTINUED ASSAULT ON THEM. THE THREE DESCRIBED INCIDENTS OF THROWING THE SMOKING CANISTER, MEET THE ELEMENTS OF COMMITTING AGGRAVATED ASSAULT AGAINST POLICE OFFICERS, ACCORDING TO ARIZONA REVISED STATUTES. OVER THE LAST TWENTY FOUR HOURS SINCE THE INCIDENT, THE DEFENDANT HAS USED SEVERAL MEDIA AND SOCIAL MEDIA OUTLETS TO ADMIT HIS INVOLVEMENT IN REFUSING TO LEAVE THE AREA, KNOWINGLY THROWING CANISTERS AT POLICE OFFICERS AND POSTED PHOTOGRAPHS OF HIS INJURIES."
...........So, three counts of class three aggravated assault, a lot more serious than a class 5 or 6. He's in a lot more in trouble than he thinks he is. I've been scanning the local news to see if GoDaddy has fired him yet, don't see anything.

A group of thugs shows up without a demonstration permit. They are armed, masked, and have a clear intent to inflict property damage, obstruct the police, and assault and injure citizens who are engaging in a Constitutionally protected right. The actions are coordinated and funded. to the point where people are paid to engage in these unlawful activities. How is this not a criminal conspiracy? How is this not a RICO violation?

I’d have been more indelicate when writing the report. It would have gone something like this...
After getting more than just a little pi$$ed at the suspect’s continued a$$holish behavior, Officer Jones was instructed to use his pepper ball gun and to aim it at a sensitive area of the suspect’s body. Suspect was shot in the crotch, fell to the ground and then crawled/limped away.
The officers in riot control formation all laughed and complimented Office Jones on his excellent shooting.
I don’t know where the perp posted in social media, but the police say that he admitted what he did on at least a couple of social media sites.
Plus, he made the TV interview rounds as I recall. He claimed that he was “just joking”, and somehow he thinks that makes everything okay.
It’s not a question of his guilt in participating in the riot, it’s all captured on video, and he basically confessed multiple times. The big question is what will the final penalties be. I doubt very much the police will drop the charges, but maybe the perp’s attorney can negotiate down on the number of counts and class of felony charges against him. This idiot had better have a good attorney.
That video clip has to be among the best of 2017. But let’s assume it won’t be in any network’s year-end wrap up.

Again, I’m on the look-out to see if GoDaddy (headquarters here in Phoenix) makes any statement about what their employee did, and if the employee has been fired. It could be that their hands are tied until the perp is actually convicted, otherwise they might end up with a big lawsuit on their hands.
Wouldn’t surprise me if some low-life ACLU defense lawyers take his case pro bono.

GoDaddy is full of these types of miscreants. He won't be fired but I'm sure they'll give him some sort of plaque to congratulate him...and probably a nice cake at the assembly in the Employees lounge.
I predict this gets pleaded down to a misdemeanor with 90 days probation/suspended sentence and a deferred judgement which will lead to an expunged record if the perp can avoid arrest for 6 months.
