While the authors of the 14th Amendment explicitly excluded “foreigners” the status of legal immigrants applying for citizenship is ambiguous. We didn’t have the categories of “legal and illegal” immigrants in 1866 but we did have a process for becoming a citizen, and I would surmise that such duly enrolled immigrants would be covered under the 14th clause.

Regarding the “birthright” of illegals, I hope Trump or Congress or both pursue the issue. A court ruling would be a good thing to have on the record.

The court ruled in 1898 in Wong Kim Ark that the children of legal residents were citizens.
They did not address the children of illegal aliens.
