New York, California get 'aggressive' when residents try to flee high taxes

The Tax Cuts and Jobs Act introduced a number of reforms, including a $10,000 cap on state and local tax deductions, which have caused Americans to look into establishing legal primary residences in states where they can limit their liabilities.

But some states give taxpayers a hard time when they are trying to change their domicile – thereby establishing their permanent residency elsewhere.

“California … they don’t particularly like when people that were large taxpayers … leave,” Marc Minker, lead managing director at accounting provider and consulting firm CBIZ MHM, told FOX Business. “The state becomes very aggressive with respect to making you prove that you essentially changed your domicile.”

Changing a domicile requires an individual to physically move with the intent to stay either permanently or indefinitely. The state of domicile determines your income, estate and other taxes.

Even when you change your domicile, that is not always enough, Minker added. If you own a property in the old state, you must be able to prove that you resided in the new domicile for more than 183 days out of the year.

In addition to California, Minker said New York is “equally aggressive,” as are New Jersey, Connecticut and Ohio, among others.

Lance Christensen, a partner at accounting firm Margolin Winer & Evens, agreed that New York State and New York City are aggressive when it comes to allowing taxpayers to leave. He said individuals must be ready to “withstand New York State and New York City challenges.”

Seven years after I moved out of California, the state was still dunning me for income taxes. I didn’t even discover this until I went to get pre-qualified for a home loan in Texas.

Four separate liens for unpaid state taxes were on my credit report - all of them billing me for “estimated” earned income during years in which I was a legal Texas resident.

Took a bit of wrangling to peel their greedy claws off me, but I did it.

Left NYS 20 years ago.

Even then they still would send me tax bills.

I told them to go pound sand, in a nice way.

For a while the California Franchise Tax Board tried to collect income taxes on people’s retirements—after they had left the state on the theory that since the retirement was earned in California, they had a right to a piece of the action. I believe the courts slapped that idea down.

Thanks for the info.

A few of the especially important things to do are file a declaration of domicile, register to vote, get new driver’s license and tags, change address on key accounts, and apply for homestead exemption.

FWIW, all the folks we know who’ve escaped from NY have been conservatives.

Now, that's interesting. I'd never stopped and thought about it, but looking back, nearly every person I knew who pulled up stakes to leave Cali, was of the Normal persuasion.

When we discussed the idea of relocating to Texas with liberal family members, the universal reaction was, "Huh? Why on earth would you want to do that?"

Conversely, our conservative friends all understood our motivations and wished us well.

This makes sense. Why allow you to buy a home in Mississippi and call it your main home but live in California the whole year.?

They should get aggressive.

Many of these folks are former system-sucking civil servants who retired at the age of 40 with a full pension then moved to a low tax state where they can screw up their new home with liberal politics.

I’m sure the taxpayers of those states who paid these people’s salary and benefits hoped they’d see some of it back in taxes.

Too much family here to never come back, plus La Jolla and Oceanside, Yosemite, Laguna Seca - and I really couldn't go through life without ever seeing the Giants, 49ers, A's, Warriors and Sharks in person again =).

I love California - I just hate what all the liberals who have moved here in the last 40 years have done to it. I can still remember the "This Is Reagan Country" posters and buttons with the outline of California from when I was a kid. All good thing come to an end - who knew they'd come to an end for an entire state this quickly.

We moved to Oregon from the Bay area almost 30 years ago, We own several commercial buildings in Marin county and the CA state board of equalization made our lives hell for several years. Our CPA solved the problem years ago and it all went away. The only time we hit CA is on the way to Texas!

When we Left (escaped from) the Freak state md, we had to pay 3% on the gross sale of our property . It was worth every penny to be able to leave that LIB sewer. What a mess that pathetic state is.
