A lawyer in Texas got a wealthy man off a murder charge after he killed and dismembered his neighbor. He claimed self defense. He was later caught on a hot mic boasting of other people he’d killed.

Premeditation means intent, but intent can arise mere seconds before the killing.

Correct. If you knock over Billy the Kid's drink, and he immediately pulls out his gun and shoots you, he is guilty of murder. I am not a lawyer either, but I did learn that in first year Crim Law.

A non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from first degree murder, which is a premeditated, intentional killing or results from a vicious crime such as arson, rape or armed robbery.

So it depends on the murder degree he was charged with. I would have to assume he is charged with 2nd degree murder.

It’s NOT murder.

But is there some law that requires you to call 911 if someone is injured right away, even if it’s someone who maybe intended to kill you?

Either way, some of these Texas folks are crazier than any Mafia guys I ever knew :)

AND they kill the bad guys.

Man, cut the guy some slack. So he only slept for two hours. I’m only 58 years old and I can only sleep for a couple of hours at a time myself because I have to get up and pee.

Hopefully they can get one or two on the jury, but a hung jury will not work as they will retry until they get a guilty verdict or he runs out of money defending himself and pleads.

Very good questions. I have to assume that the prosecutor has autopsy results, maybe showing the fatal wound was from behind the perpetrator...

The story leads you in that direction, but really short on details

Maybe he has short term memory loss ... my Dad could shoot a guy and immediately forget about it until the memory finally gets into his long term memory. He used to recall stuff he did the day before while not being able to recall something he did 30 seconds ago.

There’s a lot of work, and emotion involved in killing a criminal who illegally enters you home to do God knows what to you. I’d be ready for a nap after that too. The guy was dead. He wasn’t going anywhere. Nobody should have to give up a good night’s sleep over some POS career criminal who has committed his last crime.

How would police legal resources and public affairs handle this, if a police officer had shot someone who dropped a pickax and run away? Let’s see. A criminal who is on meth, young, thin and full of stamina could jump backwards 21 feet, swoop up the pickax in a windup maneuver and hurl it at over 100 miles per hour at the police officer trying to defend herself. Another 21-foot rule, unless a criminal or athlete somewhere manages to jump further.

What’s good for the goose,... ;D
