I think the only way this story MIGHT be true is that the man is not being investigated for a hate-crime for not having sex with the person, but with stating his reason WHY he would not have sex with the person.

You're right, of course. I'll bet this was a Tinder-type hook-up, essentially an iPhone-enabled anonymous sex act. The guy thought he was arranging for a no-strings-attached quickie with a woman. Imagine his surprise (and disappointment and disgust) when a "woman" showed up instead. (Poor guy.) The "woman" took offense when he declined to play along with "her" mental illness.
