VP Pence could have decided to send the disputed states back to their state legislatures. The Dems could have gone to the courts to complain, but SCOTUS would likely stay out of it, because it would be a political question.

No doubt I agree with this 100%. However, think SCOTUS would suddenly find themselves moving within 48 hours.

Deep State Establishment jumps right in then.
