It was a lose/lose situation.
If he doesnt’t defend his copyrights, he loses them. So he had to sue. But that had to be embarrassing.

I would think that he could have sued for some sort of nominal damages. Establish her liability for her actions and protect his rights, but settle for some token amount. She likely would have agreed to it just to avoid a judgment like this one.
