Judge James Linn noted he had two sentencing options: either a probationary period with up to 180 days in jail, or up to three years in prison.......Smollett received the best deal available to him.

.......... the judge recounted the numerous factors he believed made the case reprehensible: that Smollett had planned the hoax so meticulously, the negative impact it could have on real victims of hate crimes, the waste of law enforcement time and resources to investigate it, and Smollett’s own testimony that the judge said ‘can only be described as pure perjury.’

“The sentence can be justified by Smollett’s lack of prior criminal history and other mitigation filed by his attorneys, particularly letters of support from prominent social justice and community leaders,” Keegan continued. “As he was brought into custody to begin his sentence, Smollett shouted that he is innocent but not suicidal, so any harm that may come to him while in custody will not be self-inflicted.”

Tina Tchen issued a statement saying she knew the Empire actor’s family

She traded text messages with prosecutor Kim Foxx before charges dropped

Tchen said her only role was to connect Foxx with Smollett’s family

Michelle Obama’s former chief of staff has been forced to defend her decision to contact the State Attorney about Jussie Smollett prior to his 16 charges being suddenly dropped.

Tina Tchen issued a statement saying she knew the Empire actor’s family and was simply putting ‘the chief prosecutor in the case in touch with an alleged victim’s family’ when she contacted Cook County State’s Attorney Kim Foxx.

The attorney has come under renewed scrutiny for her involvement in the case after she messaged Foxx with ‘concerns’ about the investigation days after Smollett claimed he’d been victimized in a hate crime.

In a statement, Tchen said: ‘I know members of the Smollett family based on prior work together. Shortly after Mr. Smollett reported he was attacked, as a family friend, I contacted Cook County State’s Attorney Kim Foxx, who I also know from prior work together.

‘My sole activity was to put the chief prosecutor in the case in touch with an alleged victim’s family who had concerns about how the investigation was being characterized in public.’

It comes amid reports the FBI is now reviewing the circumstances surrounding the dismissal of all 16 criminal charges against Smollett.

Tchen, 63, wrote in an email to Foxx on February 1, three days after the purported attack: ‘I wanted to give you a call on behalf of Jussie Smollett and the family who I know. They have concerns about the investigation,’ the Chicago Tribune reported.

She became involved in the Smollett case when she contacted Foxx on February 1, three days after the Empire actor claimed that two white men had assaulted him in the street shouting racist and anti-gay slurs, as well as slogans of President Donald Trump.

It is understood Tchen has close ties with Smollett’s sisters.

She wanted Foxx to convince Chicago police to hand the investigation over to the FBI, and Foxx agreed to try.

Several hours later, Foxx received a text message from one of Smollett’s relatives.

Foxx indicated that she was trying to get the investigation turned over to the FBI.

‘Spoke to the [police] superintendent earlier, he made the ask. Trying to figure out logistics. I’ll keep you posted,’ Foxx wrote.

‘Omg this would be a huge victory,’ Smollett’s relative replied to the prosecutor.

Foxx replied: ‘I make no guarantees but I’m trying.’

Think he was making a self-written extemporaneous “PLAY” to create the impression that he IS suicidal—and get put in the lockup psychiatric ward. He might want to re-think that, if it happens through his “influence” family (the grandma covered for his queer life choices interestingly- the family must not be Trad Christian in denomination).

Re think it because he would have to be admitted, and analyzed and then....prescribed some powerful RX drugs—Klonopin for example. Just a few thoughts.

The guy is nuts in any case. And he should have had a writer for the words he spoke.

Judge Linn was damning in his verdict, noting how Smollett on the stand reprimanded someone who, quoting him, used the N-word, and yet himself sabotaged the work of activists for equality.

'The hypocrisy is just astounding,' Linn said.

'I believe that you did damage to actual hate crime victims.

'These are people who have a difficult time coming forward. There may be some trepidation.

'I don't know if they are going to be accused of acting like you, pulling a stunt like you.

He told Smollett: 'You're just a charlatan, pretending to be a victim of a hate crime.'

'The damage you have done to yourself is way beyond anything that could be done by me,' Linn said.

'You are now a permanently convicted felon.'
