Why Democrats probably won’t get rid of the filibuster for abortion

Though the conservative Supreme Court appears poised to strike down Roe v. Wade, Democrats control slim majorities in both chambers of Congress, and they have a president in the White House supportive of abortion rights. They also have public opinion on their side. But one thing stops them from passing a federal law protecting abortion rights and codifying Roe into law: the filibuster.

The filibuster is a Senate rule that requires 60 votes to pass most legislation. Most controversial legislation is passed on party-line votes these days, and it’s very rare for parties to have 60 senators. Democrats only have 50 right now.

Here’s what the filibuster means for federal abortion rights — and how it could be manipulated by either side.

Will Democrats get rid of the filibuster to pass abortion protections? Probably not.

In the Senate, Republicans can and will stop Democrats from codifying abortion rights. They already did so with a bill Democrats voted on in February.

Democrats can get rid of the filibuster, or make a carve-out for abortion-related issues, with just a majority vote. After Politico published a draft Supreme Court opinion indicating that Roe will be overturned later this spring, Sen. Bernie Sanders (I-Vt.) almost immediately called for Democrats to do that

Roe was struck down, two days ago.

Liberals have no one to blame but themselves. It is 100% their fault Roe was overturned.

A lot of people could sympathize, with the scared teenager, the rape victim, the drug addict who had no business raising a child...We didn’t like it, but we could understand.

But we went from “safe, legal, and rare”, to abortion up to the moment of birth. Actually murdering a fully formed baby up to the moment of birth.

They certainly have the option to try to codify abortion through legislation, it’s what Ruth Ginsberg was recommending. I don’t know if they actually have the votes, though. If they do, it will certainly be challenged and back in the SC post haste, but Ginsberg’s point was that legislation can be defended on any basis but a SC decision such as Roe was restricted strictly to the terms of the decision itself, which she felt were weak in Roe (she was right) and would be overturned at some point because of that (she was right). Hence any such legislation would have to be very carefully crafted. If the Dems had listened to her they’d be ready with that by now but they didn’t.

Ginsburg is also at fault for the lefties. Instead of retiring while Hussein was in office, she wanted to be replaced by a President Hillary. Boy did that backfire! I know Roberts voted with Conservatives for a change, but I think if the vote had been 4-4, he would have sided with the leftists. I think the only reason Roberts sided with us is because the repeal of Roe v Wade was a foregone conclusion.

It’s unconstitutional

Change the constitution and amendments and you can do whatever you want

49 Democrats plus Murkowski and Collins (minus Manchin). They can use the nuclear option. You could argue that they can codify abortion through legislation because there is no constitutional right to abortion. Also, they can tie it to the highway funds. If you do not allow unrestricted abortion on request, the feds will take away $$$.

Am I mistaken? I thought after the Roe week limit was reached, abortion could only occur for serious maternal health or possible death issues, which was statistically rare.

Precisely. From inside their bubble they could not see how most were horrified at killing a nine month old unborn baby. Who could forget that ghoul Governor of Virginia talking about letting a newborn die while you watched it.

Obviously, Democrats didn't want to get rid of the filibuster over the abortion issue because they know they're going to lose the Senate in 2022 and they want that minority power to block Republicans.

Why? The Dobbs decision specifically said that the Constitution is silent on abortion. It hasn't been prohibited. Why would a federal law be unconstitutional?
