I can point someone out to the police without getting close enough for them to present a threat with a piece of wood...a threat that justified shooting them. He may be on firm legal ground from a criminal standpoint, but I think he’s civilly liable for a lot more than his BB gun cost him.

Florida follows the common law rule that a citizen may use reasonable force, including lethal force, to apprehend a fleeing felon. Burglary is a felony, so there would be neither criminal nor civil liability for the pursuing homeowner.
Felons in flight beware: Florida Man may not only be armed, but the law will be on the side of Florida Man if he shoots you.

For one, “The homeowner told WJAX-TV that the intruder had also stolen $400 — money that Kerr said he would have gladly given the man should he have requested help.”
Another referencing the “3 foot long” piece of wood “3 inches thick” of the “privacy fence”.
Among many others, including when he retrieved his firearm...unless his job at “the office” prescribes that he wears one, which ‘might’ explain what comes across as lousy judgment.
There’s more, and others have pointed some (but not all) out.
