I don’t think Hamburger Mary’s is a solid business model but if I were their attorney, I would make the argument that Hamburger Mary’s, Hooters and Twin Peeks are all similarly situated and should fall under the same rules

That could be an arguement, but Hooters and Twin Peaks don't advertise themselves as "family" restaurants.
