No loot or E-ZPass required on the PA turnpike. They take a pic of the plates entering and exiting. The owner gets the bill no matter what they look like.

in maryland, it doesn’t matter whos driving, The owner of the car is who gets to pay the ticket. Its the owners problem to collect if someone else was driving, its not a points violation anyway. Stop wearing clown outfits and pay the ticket.

Up in Canada, they tie the offense to the car and let the owner pay when he needs government services. They don’t worry about whether it was the owner of the car that created the offense. They leave it to the owner that, if he wasn’t driving, he has to get his money back from the person who was driving.

I suspect California figured how to not violate the 5th Amendment of due process, so you’re stuck with your ticket.

Don’t take legal advice from the internet. Also, your questions are stupid.

There is a company giving you cheap boilerplate letters.

https://donotpay.com/

I don’t know how well it works, but at least it is something.

I once got caught by a red light camera. I had the company running it subpoenaed. Asked them to provide me with the source code for the camera. I told them that it was my right to face my accuser and since the only witness was the computer operating the camera, I wanted to cross examine it.

The company dropped the case like a hot rock.

State try to sell the idea that “driving is a privileged”. The mistake is accepting that premise. Once it’s removed from the “rights” column, a lot of civil liberties fall away.

In my experience in the Northeast, the agency sending the summons doesn’t care who is driving the vehicle. They only care who it’s registered to. They only want the money from the fine, which is why there are no points on the driver’s license for the violation.

Presumably, this gets around the 5th Amendment because they’re basically citing a vehicle, not a person, for the violation.

“hypothetically, a driver gets flashed by an automated speed trap at a california intersection, running a green light.”

This is a joke, right?

Hire a traffic lawyer. Then be prepared to appeal. How much money is it worth to you to get out of a ticket

It’s a violation of the 6th amendment

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

the owner has already been coerced into signing that he/she/they were the driver at the time of the incident.

isn’t this demand a violation of the 5th amendment?
‐-——————————

No, if you deny being the driver, you have no standing to argue other facts or theories in court.

As usual, there’s a bigger story at play.

https://thehill.com/changing-america/sustainability/infrastructure/592689-states-can-now-access-billions-for-speed/ (Feb 3, 2022)

Roadways in the U.S. could receive an influx in speed cameras, thanks to new funds from President Biden’s infrastructure law.

Federal guidance issued Wednesday states that billions of dollars allocated to highway and roadway safety can now go toward installing automated traffic enforcement, such as speed and red-light cameras.

Previously, transportation funds allocated to states were largely limited to fund projects such as reinforcing bridges and roadways, with federal funds for speed cameras only permitted for school zones. However, Biden’s infrastructure law allows states to utilize up to 10 percent of their $15.6 billion highway safety funds, distributed over five years, on “non-infrastructure programs” such as automated traffic enforcement and public awareness campaigns.

Critics have countered that the cameras can be inaccurate and act as more of a source of revenue for communities rather than a speeding deterrent. In fiscal year 2020, Washington, D.C., brought in about $148 million in traffic fines, a majority of which came from speed and red-light cameras, even amid the coronavirus pandemic, according to Washington Business Journal. An analysis even found that D.C. issued more fines than any U.S. city.

Little by little we cede our freedom to technology. We have to trust that these cameras and radar devices are accurate and properly maintained. It’s likely that at least some of them are not.

Then there’s the issue that most automated/remote traffic enforcement devices are owned by private companies. How any of this is found to be legal is beyond understanding.

The authorities, and those private companies who are profitably enriched by human error - and sometimes just by the possibility of human error, bank on the fact that most people don’t have the time, energy or resources to fight the citations.

The automated speed traps should probably be outlawed. Know of a friend who was notified through one of these which identified his license number(partially) that pointed to a violation. Vehicle was wrongly identified & the man in question had not ever been at that location & was MANY miles away when the violation occurred. Yet he had to go through all the trouble proving it could not possibly have been the guilty party. After much time passed, I guess the police realized the charge wouldn’t stick. These automated traps should be outlawed. They serve one purpose; a revenue raiser.

I also found this, with respect to auto insurance:

“Car insurance companies don’t care about the number of points you get on your license, but they do care about any accidents or violations on your driving record. So if you have points on your license from a DUI or an accident, that’s what will raise your car insurance rates, not the actual number of points.”

https://www.policygenius.com/auto-insurance/do-points-on-your-license-affect-your-insurance/

(so, some comfort from a small silver lining in all of this)
